PhotoCAD Stealth Terms

PhotoCAD is operated by Francis Field, trading as PhotoCAD, c/o St John's Innovation Centre, Cowley Road, Cambridge CB4 0WS, United Kingdom (“PhotoCAD”, “we”).

These terms apply automatically when you purchase any PhotoCAD Stealth pack or plan, from the moment your purchase completes. They supplement our Terms of Service; where the two differ on the handling of your content, these terms prevail. They exist so that the confidentiality you are buying is a contractual commitment, not a marketing page — no signature ceremony is needed for them to bind us.

1. What Stealth changes

On a Stealth account, your conversions are processed only through AI providers engaged under commercial terms that prohibit using customer content to train or improve their models, with no fallback to any other provider — if that processing chain fails, your conversion fails cleanly and the credit is refunded, rather than being routed anywhere else. Your content is excluded from administrative views, and everything you create is subject to the retention schedule below.

2. Our confidentiality undertaking

We treat all images, designs, and other content you submit to the services, and all outputs generated from them (together, “your content”), as confidential. We will: (a) use your content solely to provide the services to you; (b) never use it, or permit it to be used, to train artificial-intelligence models; (c) protect it using no less than reasonable care; (d) disclose it only to the service providers used to operate the services, who are bound by confidentiality obligations and whose terms prohibit using customer content to train AI models, and to our professional advisers and insurers under obligations of confidence, to the extent necessary; and (e) notify you promptly if we become aware of any unauthorized access to or disclosure of your content.

3. Retention and destruction

Your content is retained and destroyed according to the schedule in our Trust & Data Security page and Confidentiality & Data Handling Statement, as at their version dates when you purchase or as later changed in accordance with section 9, which are incorporated into these terms (download the statement as a PDF): automatic destruction 30 days after creation by default (configurable on your account, with per-drawing pinning to keep individual drawings), and destruction within 48 hours of deletion. Destroyed content is not recoverable. Copies held in routine encrypted database backups expire on the backup schedule stated there, and copies we are legally required to retain remain protected by these terms while held. What remains after destruction is the billing record only — title, dates, charges, and processing timings.

4. Who can access your content

Your content is processed by automated systems end to end. Nobody at PhotoCAD views it in normal operation, and it is excluded from our administrative tools by default. Deliberate access happens only through an explicit, timestamped, logged step, for support you request, quality review of a conversion you report, or abuse investigation — and any such access is itself subject to the confidentiality undertaking above.

5. Disclosure required by law

We may disclose your content to the extent required by law, regulation, court order, or a competent authority. Where it is lawful to do so, we will notify you promptly and disclose only the minimum required.

6. Your content stays yours

Nothing in these terms grants us any right, title, interest, or license in your content or in any intellectual property right — including any patent, design right, or application — beyond the limited right to process your content to provide the services. You own your conversions on every plan, as set out in our Usage Rights.

7. Countersigned NDA and DPA

If you need a countersigned mutual non-disclosure agreement for your records or your client’s matter file, reply to your purchase confirmation email or contact support@photocad.ai — we execute our standard mutual NDA (published so you can review it first), typically within one business day. Enterprise customers who require a data processing agreement can request one the same way.

8. Remedies

We acknowledge that a breach of these terms may cause you harm for which damages would not be an adequate remedy, and that you are entitled to seek injunctive or other equitable relief in respect of any actual or threatened breach, in addition to any other remedy.

9. Changes

If we materially change these terms — a longer retention window, a weaker guarantee, a change to how or where your content is processed — we will give you at least 30 days’ notice by email. Changes never weaken the protection of content you submitted before they take effect: the no-training commitment, the maximum retention and destruction windows, and the access rules that applied when you submitted content continue to apply to that content until it is destroyed, except where a change is required by law. We may transfer our rights and obligations under these terms to a successor entity that carries on the PhotoCAD business; we will notify you, and your protections will not be reduced by the transfer.

10. Liability

These terms add confidentiality obligations; they do not expand our liability. The limitation of liability in our Terms of Service — including the cap on total liability and the exclusion of indirect and consequential losses — applies equally to these terms and to any breach of them, except where liability cannot lawfully be limited.

11. Governing law

These terms are governed by the laws of England and Wales, and disputes are subject to the exclusive jurisdiction of the courts of England and Wales — consistent with our Terms of Service.
